| dc.description | ملخص: تهدف هذه الرسالة إلى الوقوف على مدى حرية الإرادة في رسم نطاق الخيار الفردي عند إبرام عقد الزواج ودورها في ترتيب آثاره، وبيان حدود انفتاح قانون الأسرة على مبادئ القانون المدني باعتباره الشريعة العامة لكل القوانين، خصوصا ما تعلق بتوظيف المشرع الأسري لمبدأ سُلطان الإرادة في إعداده للتعديلات الأخيرة التي جاءت في مجملها تمس مكامن الخصوصية الشرعية لعقد الزواج، وتسهدف إعادة تنظيم روابط الأسرة بما ينسجم والاتفاقيات الدولية ذات الصلة. الكلمات المفتاحية: مبدأ سُلطان -الإرادة - قانون الأسرة - حرية الزواج - المساواة – الرضائية – الاشتراط. CONCLUSION: Cette thèse vise à déterminer l'étendue de la liberté de la volonté et du choix individuel lors de la conclusion du contrat de mariage, et son rôle dans la détermination de ses effets, et à indiquer les limites de la conformité du droit de la famille aux principes de droit civil comme source générale de toutes les lois, en particulier en ce qui concerne l'emploi par le législateur de la famille du principe de l'autonomie de la volonté dans sa préparation des récents amendements, qui sont venus dans leur intégralité, affectent la confidentialité juridique du contrat de mariage, et visent à réorganiser les liens familiaux conformément aux conventions internationales pertmentes. Les mots clés: Le principe de l'autonomie de la volonté - droit de la famille - liberté de mariage - égalité - consensuel- CONCLUSION: This thesis aims to determine the extent of the freedom of the will to determine the extent of individual choice when concluding the marriage contract, and its role in determining its effects, and to indicate the limits of the conformity of the family law to the principles of civil law as the general source of all laws, in particular with regard to the employment by the family legislator of the principle of the autonomy of the will in its preparation of the recent amendments, which are come in their entirety, affect the legal confidentiality of the marriage contract, and seek to reorganize family ties in accordance with relevant international conventions.
